D visa in switzerland, U.S. Permanent resident, where would I be deported to??
 
Hi!

In switzerland for an internship, I want to go to Italy by train for a weekend. I have a multiple entry D visa for switzerland + a transit through Schengen (I have applied for my permit B more than a month ago and it's not here yet). I'm also a U.S. permanent resident. I'm an Iranian citizen (ooooo ;) ).

So I know the D visa is only valid for switzerland, and transit visa is only for airports. If they check my passport on the way to Milan basically I'll be illegal! So the question is, does anyone know if I will be returned to switzerland or back to U.S.??!?!

And will I be jailed or something?? I want to know how bad are the consequences of getting caught, is it worth not being alone on christmas or should I just forget about it.

Not sure if anyone knows the answer, but if you've heard of other people's experiences it would help.

option 1. Get a confirmation document from the permit issuing authority and travel happily as you're in the permit process (in theory)
option 2. Don't go to Milan. Don't take the chance. Have less hassle.

Why would you take such risks? Get information from proper authority.

Well it's not a big risk if they just send me back to Lausanne! It's only 3:20 hours by train. So it'd be worth it for me so I don't sit at home alone on christmas.

Hold on, with a permit B I would be able to travel to Italy? I thought I couldn't, and only switzerland accepts that.

I'm not going to stick my neck out and suggest that it would be Lausanne because it would not be. You don't have a US passport but I assume you have a green card?

I do have a better idea - organise something in Lausanne because you might find you're not home alone. And to get the documentation ready before this weekend....may be hard for you.

Personally, I would not take the chance.

I am a girl! And no, I'm not going for a guy, it's a friend from Iran that I haven't seen in 12 years, it would have been nice if I could go.

I have a green card, but not a u.s. passport.

I was wondering if with a permit B I could travel to Italy, once I get it? Or would I need to get a schengen?

with the B, you'll be fine. It shows that you're living with permission in the Schengen zone.

I would say wait.... 12 years and 1 month for no hassle will be worth it. I'm sure the Iranian passport will be seen first and the green card second - have a nice chat on the phone and make a late January date :)

You won't need to apply for a Schengen Visa once you get your B permit. Personally I wouldn't risk travelling without the proper papers, as you could jepodise the process of getting your Swiss permit if you get caught.

Enjoy the holidays in Lausanne and have your friend visit you instead :)

mmm... I'll go to the police station tomorrow and see what's taking so long, I applied for the permit 4th of November!! They did say it takes 1.5 months.

So I was right that the D visa (professional motive) for switzerland with multiple entry will be worthless for Italy?

Check on the topic of the D with the people you ask about the permit.

They can also give you a letter stating your legitimate residency in Switzerland. You ought to stamp this on the way out but this might not happen.

Okay, I'll go ask them tomorrow, and hopefully they'll give me the right paperwork. It seems like it's not worth it otherwise, you all are scaring me!!

As I understand it the norm is that you will be deported to your country of origin - in your case Iran! It happened to a US work colleague of mine a few months ago. The Italians took exception to his numerous business trips and claimed he should have had a work visa for Italy. Even though he had a valid permit for Switzerland, they still returned him to the USA.

Also, if they deport you anywhere, you will have this "black mark" on your passport, which should (will?) be communicated to all Schengen countries. It could cause problems for you in Switzerland and all the other Schengen countries in the future.

Assuming you have a green card, you need to be conscious about the length of stay you have in Switzerland; your green card will be useless if you remain out of the US for more than 6 months. So I would check that if applicable to your situation.

Answer is as follows:-

Permit D - Not Valid to travel in Schengen States.
Permit B - Valid

Will need to apply to the Italian Embassy at Bern to get the Visa.

If Caught:-

1 - Jail in Italy for Interrogation with the Italian Police/Swiss Police and then also Homeland Security from U.S.A (if you have a green card)

2 -Eventual Deportation to Iran whenever all the above queries finish with respective authorities.

Result - Will never get an entry again to U.S, Switzerland to either travel too or reside and ofcourse all schengen nations you will be blacklisted too as your passport will be stamped for this purpose.

Soo if you are ready for this adventure - go ahead.
