Entry on Tourist Visa while Study Visa is in process

While I've searched thoroughly in the forum for an answer to a few burning question I have, I have not been able to find them. So, I hope you can help me.

BACKGROUND
My wife has been accepted to study at the EPFL. Her course starts on September 6 however we will only be able to apply for her visa next week (very tight). She is a Venezuelan national (she can stay in Switzerland for up to 90 days without needing to ask for a visa) living in Japan and I am a Mexican national living in Switzerland (B Permit) for 2.5 years.

QUESTIONS
1) Would it be ok for my wife to start her course, staying in Switzerland as a tourist for a few weeks, in case her visa is not ready by the time her course is due to start? (we understand that she would then need to fly back to Japan to get her visa stamped once it is ready).

2) Is there any concern by having a spouse asking for a Student Visa where she can, in principle, ask for a B permit under family re-unification? Which process you would expect to be faster? Would she have problems later in wanting to convert from a student visa to a B-Permit?

Technically not but practically it's usually ok although universities advise against it. The visa can be picked up in Germany or France by the way.

A question I was about to ask .

Go for the B permit - your spouse has the right to one and it includes the right to work and study in Switzerland. Forget the student permit as it is nonsense in this case.

When she arrives as a tourist on the visa waiver programme go and register at the gemeinde, complete the forms etc. She will not require a visa at all and as such will not need to make a trip outside the country.

Thanks for your reply Swissbob!...

Are you sure that if we go for option 2 she wouldn't need to get a Resident Permit in Japan before coming to Switzerland to register?

I ask as we completed this process last year (under the advice from a relocation service provider) although at the end that effort was lost (the permit expired before she could come to Switzerland) as we had to postpone our plans for her to move by one year due to work commitments.

Do you mean a permit or a visa? She would not have been able to get a permit in Japan - that only comes after registration.

Thanks Swissbob...

In this context, I meant visa. We had to get a visa for my wife to stay more than 90 days (Venezuelan nationals can stay in Switzerland without a visa for up to 90 days).

Hope this clarifies what we had to do with the Swiss consulate in Tokyo. As you can tell, I am not very familiar with all the terminology.

As you are married you'll get her permit well within the 90 days once you register. It is likely they won't even issue a visa in this case but if they are fussy then arrange to collect it in Germany.
