Here is the trouble i have to deal with Swiss authorities. I am a Non-EU Pass holder with a valid German work permit. I have been living in Germany for 4 years. I have got a master degree in software engineering from Germany and been working there for couple of years. Recently my boyfriend(EU pass) got a new job in one of the banks and we relocated to Zürich. Then we registered at the stadt office and applied for the permit on 15th July. He got a B permit and started working, i was waiting and meanwhile searching for prospective employers, until yesterday i got a letter from the Migrationsamt which says i have to leave the country and apply for a visum from abroad and stay there until the swiss authorities verify if they can allocate a permit or not.
We went directly to the Migrationsamt in Zürich and try to discuss the fact that we are having an apartment in Zürich, and i am not living in germany anymore, the response from the old lady was very rude. She insists i must leave the country, and even if i apply for a visum the chances of getting a permit are null.(excuse me?)
Legally i am entitled to stay here uptil 3months, which ends of 14th of October.
The best case is, i find a job in the meantime. If not he resign his job and we have to go back to Germany, as he doesnt wanna stay here alone. In that case we lose a lot of money which we had to spend in here in many ways..
My question is as he pays his tax in here and hold a 5 year B permit, why the authorities refuses the fact that he can sponsor me and give a residence permit for more than 3 months.
Is there anybody out there who has some idea about this kind of situations/ or the article 10 Abs.2 and Art. 17 Abs.1 of Bundesgesetzes from 16.12.2005? Any good lawyers/ advices can help a lot..
Any suggestions that can help us in this case are welcome..
