Well?
Whether the minaret initiative's result violates the right to express religious freedom will be decided by the European Court on Human Rights.
There are discussions to review the compatibility of all future initiatives with Human Rights and other international conventions accepted by Switzerland upfront by the department of justice. I think there is even an initiative in support of that which - paradoxically - was criticized by the SVP as not being democratic.
