Passenger pepper-sprayed by ticket inspectors

Don't know if anyone else saw this, but a passenger on the BLS who had forgotten to stamp his ticket and then gave a false address was pepper-sprayed and tackled to the ground by the four ticket inspectors.
http://www.20min.ch/news/basel/story...ahrer-29104510
Other passengers were affected by the spray too.
Talk about over-reaction, surely they are liable for assault and possibly false imprisonment charges? He was drunk, but didn't try to attack any of them according to the report (which is reason for carrying the spray, apparently).

I don't think you get "Authority" overreactions in any other country

He gave a false address!!! Isn't that akin to treason in Switzerland??

Re: Passenger pepper-sprayed by ticket inspectors

The passenger gave a false address, so the inspectors decided that police action was necessary. When the passenger wanted to get off, the four inspectors pulled him back and told him to remain seated, (until they got to Langenthal were the police were waiting). The man fought back.

Using pepper spray in a train is a bad idea - being a confined space. But otherwise the actions of the ticket inspectors, toward a drunk and apparently violent passenger, seem appropriate.

In any case, there will be an investigation, to see if the action was proportionate.

it IS boring.

In england, they'd have let him get off then dragged him into an alley and kicked the shit out of him.

Now thats proper justice.

Re: Passenger pepper-sprayed by ticket inspectors

I don't know what rights the ticket inspectors have, but I'm not sure that manhandling a passenger is one of them, drunk or not. They forcibly prevented him from leaving the train, he became abusive. I didn't see anything to say he became physicaly violent.

Same thing back home. I remember having a few cops threaten to do that if I didn't stop singing in the back of their cruiser. I shut up fairly quickly

And I read it that he was. And there's the rub. We've both read the same article and come to different conclusions. Unless we were there, we don't really know what happened. And even if we were, there's a good chance of misinterpretation.

I've no idea whether the inspectors were within their rights or not. That'll come out in the wash. I do know that when some overstepped the mark in relation to the son of a friend, the police gave them a bit of a verbal slapping.

Not any more. It definitely is him. But, hang on... Jeremy on a train? Must be a challenge thing.

Jeremy Clarckson got pepper sprayed for being drunk in Basel, we discuss that now..

Could be him, maybe his car was parked on a bus stop?

I think this is the relevant passage:

"Als der Fahrgast in Langenthal Süd aussteigen wollte, zerrten die vier ihn zurück und sagten, er müsse sitzen bleiben. Der Mann wehrte sich und drängte zur Tür. «Ein Kontrolleur setzte darauf den Pfefferspray ein», so A. M."

"defended himself" and "rushed to the door", but no mention of him becoming violent, even though the "atmosphere" was said to be violent just prior to this.
But you're right, this is an eyewitness account and is open to misinterpretation.

Is someone can tell me if in the law, ticket inspectors are allowed to use force / violence against a passenger?

I don't think they are. In much the same way as shop security. Remember the thread a while back about unnecessary checks by a security guard?

The one in the electronic store? i do, we had a discussion there about it.

Again its your words against his, they can say he was "attacking them " and use the spray as self defence.

In that case, everyone can have pepperspray with them and use it in case we fill cornered..

How and when did they found out his address was bogus? Did they check his linkedin profile with their smartphone? Or facebook?
