Are children allowed to sit on the lap of parents in the back seat?

Hi
We are a family of four - with two children 8 and 4 . We plan to drive to Germany with a couple of friends. If we had to include two more adults into the car then one child has to go on the lap of one adult. Question is if it s allowed in Switzerland and Germany? Appreciate your inputs.

I highly doubt it, it's a bit dangerous is it not if you have an accident? I'd say no it is not OK - up to you if you want to risk it

Absolutely not, each passenger in a car must have his/her's own seat belt or approved child seat.

definately definately not allowed. Very very unsafe and extremely dangerous for the poor child.

I can't believe you're asking this??!!
Law and common sense state that every person should be seated in a proper seat and restrained with a seat belt. Children (in CH) under 12 yrs. old or less than 150cm tall need to have a proper approved child booster or full safety seat.

Not only would your action be illegal and highly dangerous, it would without doubts invalidate the car insurance policy.

I having trouble believing parents actually ask this question...There have been a few similar in the last few days.

Forget the law, trust your common sense and instinct. When that fails, the law is there to assist the needy.

I don't remember the exact words, but it is not legal. The younger has to be placed in the car seat, the older one should have the booster insert under his/her behind, both strapped with seat belts, the cut off is 150cms, if I am not mistaken. Here is a link to more info.

They enforce it, too. I saw a car leaving a motorway service station and a police car which happened to be leaving at the same time pulled the car over.

They had unrestrained kids in the back and, okay, the car was from Austria, but it goes to show that the police obviously make no exceptions.

It is European Law, all children up to 12 years old or 135 cm tall, must have correct seats, and be correctly belted. http://www.childcarseats.org.uk/law/index.htm

Swiss law now stipulates minimum height of 150cm - and 12 yrs. - whichever is attained first.

For anyone to even consider doing this then I think that we can safely say that "Common Sense" has already left the building. Fortunately the law is there to protect the offspring of the common-sense deficient.

To the OP, NO it is not legal. The reason being that, should you be unfortunate enough to have an accident, anything (your child included) that is unrestrained will be propelled at speed towards the front of the vehicle.

And please explain your logic? Maybe it could be legal you're thinking because the person onto whom the child will sit must be ready to hold (very) tight the child in case of an accident? ...

I recall not too very long ago when seat belt laws were implemented in the U.S., the moaning and complaining that went on from people of all walks of life, most of whom I would say had pretty good common sense. I also recall sitting on my great uncle's lap so I could steer his Mercedes- what a treat!

Most of Europe implemented seat belt laws in the mid 70s, the U.K. and U.S. in the mid 80s. As I said, I remember quite a lot of resistance to them.

Bear in mind that the EF is a place where people from all over the world congregate, and what now seems like the Stupidest Thing In the World (not buckling your kid in) to the folks who've been mandated to wear them for a quarter century or more may not be such an ingrained behavior for someone from a far away land where they talk funny.

And while the above makes sense, the topic is common sense and I'm sensible enough to know that we'll all carry on preaching.
The question again was the legality of it.

There are many parts of the world where seatbelts are not worn as a matter of course, and you cram as many people as you like into the car. Not everyone who lives/comes to Switzerland is quite up with Western safety norms.

I often have to remind my more Easterly European friends to buckle up in the back.

Such behaviour would be perfectly normal in places where a more "fatalastic" (i.e. if your number's up, it's up) attitude exists.

But OP, no, it is not allowed in Western Europe (in case the message hadn't got through ).

Before we get too carried away, the OP gives their location as Zurich and join date as well over a year ago, despite this being their first post.

Although this info. could be wholly inaccurate and meaningless, it could also suggest that maybe they should have a slight inkling on how things are in this part of the world - even if they come from Farfaraway, where it might still be acceptable to try to break the Guinness record of how many people you can cram in a mini, everytime they go travelling.

To prevent another indigent outburst when a fresh bunch of EFers come online tomorrow, I think I'll take the precaution of closing this.

I think we have safely established that it is not allowed. Fortunately a couple of EFers have also pointed out that this is, for some people, a new area and they asked because they didn't know. Some of the rules about children's seating etc. are comparatively new. Much better to ask on here than to try it out and run risks of either injury in an accident or a brush with the law.
