Hi all,
Does anybody have a link of official info about the 19% VAT we can claim back when exporting a car from Germany?
I dont know how it works in situation, i gonna move from Germany to Switzerland and want to buy my company car to bring with me. Sixt is company which manages my car tells me "nobody will reimburse the VAT to you" and "the car can be sold to you, to a german address".
Is it the case that only if I are buying from the a Swiss address then I can claim back the VAT?

Legal background is the German UStG http://www.gesetze-im-internet.de/ustg_1980/

also since you wont own the car for more than 6 months, you'll have to pay approx 12% swiss vat for import...

Get a statement from your company (your very own?) the you were responsible for all cost associated with the car.

Yes its my very own company.
in detail, company buy (i guess) cars and let employees lease them. So the register paper has company name. Company also pay for insurrance, maintanance, etc...we pay a leasing fee every month plus a fix amount of charge if we make an accident. After four years we must return the car and get a new one or buy this one. Also can buy if leaving company.
So if i buy now i only "own" it on paper from now. But i used it since 2 years a a leased car.

Because as it is your own company you can make your own rules. Two options:
-Sell it to yourself after you moved to Switzerland, then you can reimburse the German VAT yourself, but pay Swiss VAT and car import tax on net sale price, plus duty per weight if manufactured outside EU.
-Write yourself a statement that were the the wirtschaftlich berechtiger which paid all charges (a little lie) and import it tax and duty free as part of your household.

Concerning option 1, I thought we only can claim back if it was a commercial car? Once I buy it then resell it to myself (or can sell to my bf in CH), maybe it's no longer the case?
Is private seller able to claim VAT back?

When you say 'my company' do you mean 'the company I own', eg winch.gmbh
?
OR
do you mean 'the company I work for', eg sixt?

OK, look, as buying a used car you don't pay VAT, there is nothing to reclaim.
Also, you will have to pat 12% to the Swiss, as you didn't own it 6 months before moving here.
