Please help! Just sold car, now buyer wants to give it back

We are leaving Switzerland at the end of this month and we just sold one of our cars. We met a guy at the train station, he inspected the car, drove it around, etc. He paid us cash for our car and we took our plates.

15 minutes later, as we were driving home the buyer calls us and says he wants us to come back. "Something major" is wrong with the clutch. We told him that as far as we are concerned the sale is final and we are not going back.

I know in the US that once you buy a used car from a private seller, the sale is final. Is that the same in Switzerland?

Just don't get it back!

It looks too dodgey, especially the guy might had time to duplicate the keys or something similar.

In 15 mins? Swiss efficiency that good is it?

OP, is there a problem with car you hoped would go unnoticed?

I had a friend who got screwed by some punk who sold him a car that had various faults hidden with it and it's cost him a fortune so I can relate to both sides.

Maybe offer refund cost of clutch if you know this is/could be true

Agree. They test drove it, and said it was good and bought it. My wife sold a car when she left CH for NZ, and very shortly after the buyers contacted her dad to say they wanted to give the car back and get their money for something. Actually it was a legitimate complaint, but they bought the car in the full knowledge that they would have to fix the problem (new catalytic converter). Her dad just told them flat out "no" and they never rang back.

If there is a problem with the clutch, you should notice it right away during the test drive - not after the buy.

Thanks for all the great replies.

I have the car regularly serviced at my local garage and know there is nothing wrong with it. The clutch shifts really well and I haven't noticed any slippage or bad shifting problems or noises etc...

Coincidently, he called to complain about the clutch and said it would be thousands to replace. However, he didn't notice anything during the 15+ min test drive.

I feel like he is just trying to get money back from me. He already negotiated me down thousands and the only reason I agreed to let it go for so low is because we are leaving the country at the end of the month.

The guy works for a garage and said he was a mechanic. Since he buys cars for a living I think he should know what he is doing. I really don't trust this guy.

I still owe him a second key and the winter tires, which are at my garage. I was going to meet him at the train station Monday to give them to him, but I'm having second thoughts about meeting him again in person.

I told him that if he wants the extra key and tires he could pick them up at my garage at his convenience.

Does this sound reasonable?

Absolutely - and if he works for a garage, it won't cost him so much to repair as he will get cheap parts and do it himself. Stick to your guns. Did you let it slip that you are moving abroad soon - and he thinks he can do a fast one.
Just say 'NO' - if he is a mechanic, he knows the score. Check before you buy - he could have taken it to a garage and put it on the ramp- but he didn't or get the TCS (Touring Club Suisse) to check it out. Stuff him. Bonne chance xx

And keep in touch - we come to the UK regularly and normally go past your new home from East Leics to Surrey to avoid the M1 - and to go to the Outlet stores at Bicester (American style ... you'll feel at home there, with a Carluccio Italian restau and other eateries).

ahh this scares me. I am trying to sell my car too and I will try to remember not to mention that I am leaving the country soon so that they will feel I am desperate to sell (which i actually am).

This is a simle case of "Buyer Beware"

a) You sold the car in good faith
b) He had his opportunity to test his decision.
c) I guess he just has a strong sense of 'Buyers remorse'.

Just walk away from this..... my guess is he had another sale (of your vehicle) that fell through within 10 mins of the purchase.

Drop the keys and tyres off at the garage where you had the car serviced.

He can talk to a 'real' mechanic then to get the low down on the clutch.

......... It's lucky he negotiated thousands off the deal to replace the clutch.

The guy is a goose....... laugh it off and pack your bags.
