Caught Speeding while on a Test Drive

While taking a car out for a test drive during a promotional event, a friend was flashed while speeding on an empty street. She gave the car company who was doing the promotion her real name but a fake address.

She got an email from the police saying..
Sie werden zur polizeilichen Einvernahme als beschuldigte Person vorgeladen. Bitte beachten Sie nachfolgende Angaben.

which according to Google translate means, You are summoned for police questioning as a suspect.

I've never heard of being summoned for questioning as a suspect for a traffic violation. If they've caught you and know it's you, shouldn't they include in the letter 1) how many km/hr you were speeding over the limit 2) a picture of you 3) the fine or how the fine will be determined ?

Is this something she can just ignore since they haven't presented any incriminating evidence that proves it was her?

The crime isn't just speeding any more.

Re: Caught Speeding while on a Test Drive

Riiiight.

So, your "friend" gave her name and a fake address and is then asked to come in for questioning...

Any coincidence here, maybe, between the fact that they have her real name, looked it up, couldn't find her at the fake address, then searched for her and want her to come in because someone with her name has been caught speeding and they want help with their inquiries?

Besides, what kind of camera was it - most permanent ones, AFAIK, take a photo, so they just need her to come in and *ahem* clear her name. I'm sure any confusion will be cleared up right away.

If not, they might also ask why she gave a false address.

But she can ignore it all if she wants to...

Re: Caught Speeding while on a Test Drive

She is registered as living in a different canton. She was only temporarily in the city with the car promotion.

It seems like the police don't know who she is. The car was a promotional one so the license plate isn't registered under her name. If they knew who she really were, the police would have mailed a letter to her real address I think.

I'm not quite sure what the being in a different Kanton has to do with this, tbh.

Did she have to give her email address as part of the promotion? Companies who run these promotions like to have emails.

Anyway, her call.

As the adage goes: Might as well be hung for a sheep as a lamb.

So to add to the speeding fine and falsifying information, the police can add obstruction of justice.

Well, seems your "friend" spins her own web.

The Police`s details are retained until she presents herself for questioning, or a warrant for her arrest is issued, whichever comes first.

By giving a false adress when taking an auto for a test drive ..... well, the story could be much longer and more involved than merely disobeying the law, being caught (flashed), having to be traced (email), ignoring a request by the police (the email message), and finally just ignoring their instructions.

Perhaps all they are wanting is to know which country to deport her to?

It's a friend, but I WAS in the passenger's seat and it was I who suggested we should do this so I feel like it's partly my fault for getting her in this situation.

Right, I feel like it's just a trap. Once she goes they'll be able to confirm that the person in the picture is her. I'll advise her to just ignore the summoning.

I'll have to ask her about that...If they DID, then avoiding the summons would be the last thing she'd want to do.

If the promotion company didn't take a copy of her driver's license then more fool them. But for your friend she would be playing with fire. An email is not an authorotative form of communication, so she could wait till they contact her in writing. But if she wasn't going that fast then she should just go and pay the small fine.

Don`t you think it`s time to stop giving your advice? If, of course, this person is REALY your friend? After all, which of you is going to suffer from these mis-deeds? Of course, you can be a real good friend and ask to visit and bring chocolates on visiting days.

Re: Caught Speeding while on a Test Drive

I think the address can be explained by saying "It was stupid, I just didnt want junk mail from X", if she's got a "clean nose" it might just be a slap on the wrist. But only if it looks like she is cooperating fully with the rest.

Where's the trap? She was speeding, has been caught.

Your last piece of advice is just plain daft.

That's what you think the advice on the previous posts are recommending?!?

Look, it's your life and you can live it as you want. But this is one of those little things that, if ignored, can quickly become a big thing.

Re: Caught Speeding while on a Test Drive

This I'm not sure about. It was over 2 months ago and we had forgotten all about it. I don't know what the limit was either or which street exactly it was.

It was probably ridiculously over because the street was empty and she revved like I've never seen anyone rev. It was also only for like 5 seconds she did that, but we got flashed nevertheless.
