Inspection/MFK when buying a used car privately?

Dear all,

I am buying a used 5 year old car from a private owner. The looks to be in good condition. However, I want to make sure I am not buying a lemon. I asked the seller if the car has passed an MFK but he said MFK only applies after 6 years (i.e. if I buy, I will be the one to face the first MFK!). Can you please advise if I can ask for one or all of the below:

- Can I still ask the seller to take the car for an MFK and make my purchase conditional on the car passing the test (or agreeing that the seller will make the repairs needed)?
- I read on TCS website something to the effect of putting a clause in the sales contract that essentially says that the buyer will pay for a TCS inspection test within a month of the purchase but the Seller will have to pay all costs of repairs required

I understand I can 'ask' the above - but I am looking to check from you guys (my experts ) on whether these are the norm (or OK to ask for).

Will appreciate any advise!

First MFK is at 5 years - although typically if you buy a 4 year old car the garage will give you a fresh MFK.

Second MFK is at 8 years

Then every 2 years.

If you buy a car over 10 years old - with an MFK older than 1 year it will need a fresh MFK.

If the car is 5 years old - it should pass. Get the seller to put a fresh one on. If they won't. Walk away.

Art. 33 Abs. 2b VTS
First after 4 years, then after 3 years, then every two years. Legally an MFK is over due. But depending on capacity and leniency of your cantons control place the interval may be much longer.

Legally (as in you won't find any law) there is no need do an MFK outside this intervall if the ownership changes. But: some cantons request one if the car is older than 10 years and if MFK is older than 1 year.

It is advisable to not buy a used car whichs MFK is older than 8 months.

You can have an MFK inspection done at any time, regardless of age, just make an appointment.

I have always bought used vehicles on condition of a new MFK.
