Caught for Fahren ohne gültigen Fuhrerausweis [Driving without a valid licence]

hey guys,

Today, i was taking some private lesson from a friend(with European licence) near the Mountain side of Basel.
The police caught us and i had International driving license but as I have not changed it since my arrival in basel in 2012, the police said its illegal.
I know i was on the wrong side of the law.
So, here they took away my International Driving license and gave me a yellow Slip( Verfügung und Bestätigung einer Sicherstellung) with reason "Fahren ohne Gültigen Führerausweis"

My question is,

1) has anyone ever been in such situation? If yes, how much fine did they charge?

2) How long will i have to wait till I get the license back and exchange it for the swiss one?

Thanks all for your inputs

Re: Caught for Fahren ohne gültigen Fuhrerausweis [Driving without a valid licence]

The "International Drivers Licence" is not a valid document in its own right anyway- do you not have one from you original or previous country?

So whether you get it back or not is irrelevant, as you could not exchange it anyway.

I suspect that you're not going to be able to do a simple exchange at all now, even if you do have another national one to exchange, so you'll need to brush up on your German or French, as well as your driving skills, in order to take the test from scratch here. The fact that you were driving after your first year here means they'll probably not be prepared to be flexible.

Re: Caught for Fahren ohne gültigen Fuhrerausweis [Driving without a valid licence]

I assume your original licence (assuming you had one) was from India which you anyway cannot simply exchange - you would have to do a kontrollfahrt first. At the very least this would still have to be valid, not expired. However as Ace says you will probably have to do a full test now.

Don't know what the fine is...count on expensive.

edit - checked:

Quote:
Der Strafrahmen bewegt sich neu zwischen einer Freiheitsstrafe von bis zu drei Jahren und/oder einer Geldstrafe von bis zu 360 Tagessätzen à maximal 3000 Franken.
Up to 3 years prison plus fine of up to 360 days at the appropriate daily rate for your income (max CHF 3000 per day). Although maybe they treat this as an expired licence which is "only" 180 tagessätzen.

A friend was in a similar situation - he was actually still underage at 17. It will be costly, this is an offence which goes to court, so you will most probably receive a fine (few 100 Chuffs) + admin costs 200-300 Chuffs.
My advise would be to keep aside 1k.

Re: Caught for Fahren ohne gültigen Fuhrerausweis [Driving without a valid licence]

Ouch. This is not just a simple traffic infraction. It is a misdeamor which has the worst case scenario of a jail sentence of up to three years.

https://www.news.admin.ch/message/in...e&msg-id=42788

In your case it will be a hefty fine, plus court cost, plus potentially a driving ban which come with additional cost. I go with sankbhat: Save at least 1k for this story.

Does driving without a valid license also not infer driving without insurance?

No - insurance is tied to the vehicle, not the driver.

I'm sure that insurance for the car is only valid if you have a valid license. The license for the car thing doesn't cover this IIRC.

This is not true. The car has valid insurance if it is plated regardless of who is driving, or if they have a license, or if the insurance has been paid.

To be exact. This goes only for third party liability insurance. Damage to the car may not be covered. And if the owner of the car acted in bad faith for ex. giving the keys to an non licensed or intoxicated driver they may recover all of their loses from the owner.

Thanks so much guys.
Ya getting ready to face the fine now.

Just worried if they would return my national license which is valid till 2021.

Can one also go for a driving course within these court and police procedures??

You haven't understood the serious situation have you? Your license will be returned to your home country and you will be banned here from driving for maybe 1 or 2 years.

Yes, that is something to consider too. My underage friend's dad, who was sitting in the passenger seat, when he was caught, was also fined, if I remember correctly.

It has the same consequences:

This is not the U.S.: No license, no right to drive. (Only exceptions you forgot it somewhere, than a small fine is due if checked. Or you are in the process of getting a new one because of address change or similiar, no fine in this case).

Before you can drive again you need a license. Either a learner permit, if they issue one. Or you own with an exception that you can only do supervised drives until your Kontrollfahrt. Like you did but this time legal.

Re: Caught for Fahren ohne gültigen Fuhrerausweis [Driving without a valid licence]

I still don't understand what country you licence was from? A international driver licence is only a translation in other languages not a valid licence on it's own, without the orginal with it from your country your real trouble. Even then there is a time limit your allowed to drive before exchanging yours. But no such thing as an international drivers licence.
