Alleged parking offence in Serbia

Last year we went to Serbia on holiday and about 4 months after we have came back to CH, we have received a letter to pay some alleged parking ticket.


Letter was sent from Sweden on behalf of company based in London, called [company name removed].


They even have a photo of our car in it and are demanding money. I do not recall receiving any PCNs over there. Also, what shall I do with this letter, as I have found another thread on EF where same company was trying to enforce PCN from UK. What was the outcome of that case?


Are those people are able to enforce those payments in CH and also, I am not sure on what legal grounds are they trying to issue us such demands.


Do I just pay those 40ish CHFs and forget all this palaver, or I have other legal options against them?

It is more or less a scam that is based on your parking offence . They are trying same things from Croatia.
- if they want to take things further they need to do them in Swiss court
- if they do this they need to prove:
the merits of the case (that you didn't pay)
your guilt, photo that you got is not a proof.

It is going to be a civil case not one for traffic offence, so it is not automatically responsibility of the owner of a car. They have to prove it was you who parked the car.

Got one for parking in the uk before christmas, sent from germany but with uk address and swiss bank details. Ignoring it

Neither Serbia nor Switzerland has signed or ratified the European Convention on the Punishment of Road Traffic Offences http://conventions.coe.int/Treaty/Co...52&CM=4&CL=ENG
It's not a popular CoE convention; on the other hand there may be other grounds under EU/EEA/Swiss law and treaty to enforce payment -- especially (thinking of the Lugano Convention) if it is reduced to civil judgment.

But what do I know.

That is also what I would like to know, how likely are they able to enforce the civil judgement in Switzerland.

If it makes you feel better go to pepipoo and post in the private parking section. Few people here are mixing up civil and criminal in the same stew pot
