Fine for using the phone while driving!!!111one

So a few weeks back plod caught me briefly holding my phone while driving (not texting or calling - and I put it down almost immediately). There was a certain amount of butt clenching and drawing in of breath while I mentally prepared myself to be bent over the barrel. The very friendly policeman wrote me up for a Minor to Medium Traffic Offence according to Art. 90 Abs 1.

I have now received a fine in the tune of 580 CHF (300 CHF fine + 280 CHF court fees)! I also have a record that will go to the Migrationsamt, yay!

Curiously enough, no complaint threads were opened in the process and the punishment was accepted stoically.

How boring.

Just wait for the letter from the SAN/StVA with warning or ban plus even more fees.

Question: Why could Mr. Policeman not fine you according to No. 311 OBV (CHF 100), did you swerve or nearly hit an object?

That seems a bit harsh, I was fined Chf150 (I think) in Zurich city for talking on the phone but I had an excuse as I explained to the officer "I am lost, my child in the back seat has just projectile vomited and is crying - we need his mother who is on the phone" all of which was true but still got a fine!!

I think it's good that he triggered Article 90 only... instead of Article 50. It would have been subject to very long referendum and much stiffer fines to pay in the end ...

I asked the same, apparently this is the default course of action for fondling a phone while driving. If I had swerved or nearly hit an object it would have been Art. 90 Abs 2. and they'd have pulled out the barbed club. I did not have any mitigating circumstance really.

Apparently this should not attract a ban (being my first offence against the sensibilities of road traffic), but I await the STVA letter with continued stoicism.

Fondling anything is probably not a good idea whilst driving. And if it's in your hand that's not generally just for the feel good factor.

Well that's Switzerland for you... Murdering someone - that's ok, probably had a difficult childhood. Look at the cell phone while driving for half a sec - God forbid. Yes that's exaggerated and yes, I know texting while driving is really not a good idea, I don't condone it in any way

I thought talking on the phone/checking messages/whatever while driving is fined with 100 CHF though http://www.linker.ch/eigenlink/verkehrsbussen.htm See "Verwenden eines Telefons ohne Freisprecheinrichtung während der Fahrt".

Bit confused about the 300. And even more confused about the court fees. What court fees?

I also thought that you only get an administrative fine for using a phone, perhaps they are looking to pad the budget? I'm not sure why 300, the policeman said he'll write in the report that I didn't swerve/endanger anyone so the fine should be light. Maybe the "didn't" part got erased accidentally

Re court fees, sorry I didn't mean court fees but the extra process fee you are privileged to pay when your case goes to a judge (ie. anything that's not just an administrative fine).

Would you mind to show an anonymized scan of the Statthalters letter? Really wondering why it was not resolved with a simple fine. Something is amiss.

I reckon about one in four drivers are handling their phones while driving, as seen from the balcony of my city pad. Which explains a lot of near death experiences as a cyclist.

Commiserations to Xynth for maintaining humour, not moaning. The fine seems quite steep. Perhaps pop down to a cop shop and ask them straight up if the fine is usual?

Saw a cyclist texting while cycling. He'd probably maintain it was hands free - and technically he was. His hands were free of the handlebars. I was tempted to sound my horn as I drove by, but decided against it in case he fell off.
