Setting up a Car Sharing Club

Anyone with experience in setting up clubs / associations in Switzerland?

The idea popped up at the weekend while I was having a coffee with a friend. The vehicle is a VW T6 California Camper. Since we don't envisage to be using this kind of vehicle all year round it makes sense to share it as we would share the costs, depreciation and of course usage of said vehicle.

I was just wondering what is the best way to go about it legally, financially and practically.

How would it work in terms of ownership? Insurance?

The basic idea is very simple, we contribute equally to the costs and get to share the benefits equally or pro rata according to contribution. Although I'm leaning towards the equal membership for the sake of simplicity.

Obviously if this works out there is potential that we might add more vehicles or even allow more people to join.

I remember a while back I saw a group of people in Zurich who set up a classic car club, they had about three or four cars and had two different types of memberships depending on contribution and usage. I can't remember what they were / are called and no idea if they're still going.

It will be interesting to hear your comments.

Well, there's is this thing called "search function"

To be honest, I did remember the thread as the cars offered by the "club" were not that sought after.

Keep it simple!

Draw up a contract between the 2 of you listing out:
1) Purchase price - 50/50
2) Fixed costs (insurance/road tax/parking) - 50/50
3) Variable costs (service, tyres, etc) - pro rata of total KMs
4) Minimum term - with termination of 3 or 6 months
5) If one person wants to sell the vehicle is appraised at trade value - and is bought out for 1/2 that amount
6) Use - take a calendar - create high, mid, low dates. Alternate picks. Alternate who picks first by year.

Didn't return that thread for some reason, should have used google or advanced

I looked at it again, I think my idea is somewhat different, this will be purely a private club for friends and family. We would just be sharing resources and costs for vehicles that we want to make use of without full ownership.

Re: 3) Fixed costs we agreed that it would be 50/50 and that if someone uses it less it could be rolled over to next year.

Re: 4) We discussed one basic option, which is to lease and then terminate lease after 3 or 4 years. So minimum term is 3 or 4 years respectively. There is potential to buy after that period but we haven't really discussed it further. I can imagine that if someone wants to buy at the end of the lease period that the person who doesn't want to be paid should be compensated in the difference between market value and residual value.

Re: 5) We said that if someone wants to sell before the minimum term then he would have to find somebody to take over their share, or if they offer it to the other person it will have to be offered at a discount. 20% was the figure thrown around.

Re: 6) We said that given a 50/50 ownership, we would have usage rights on a bi-weekly basis. But if someone wants to use it in the time where the other person has the right to use it then we can always negotiate. I don't see us using it for more than one month a year + some long weekends anyway so small date arrangements shouldn't be an issue.

No worries, the search function is a mess. I remembered that it was either called car sharing or car club. On a more serious note, since you're The Love Doctor, will you name the car "The Love Mobile" and how much would you charge per "outing"?

Lots of people share boats.

I had a quick look for a a sample boat share contract and the first site I came to had a campervan share contract.
On this site, you do need to purchase the contract but it's not much and it may include a lot that you haven't considered such as, off the top of my head:

Should the inside be cleaned after use.
Should the outside be cleaned after use.
who does the yearly clean.
Smoking rules/cooking rules.

I could not possibly imagine sharing a car with someone else- which means it could be useful for you:

-Draft some "agreement" in regards of what's tolerated damage, and what should be repaired (ex: should a 5cm bump without paint on the door be fixed? completely fixed as new? etc...)

-Same for "serious repairs", who's liable? Ex: if some belt break, who is responsible at the time of breaking?

-Define "fair use" (ex: if one "uses" the tyres or the gear box because badly driving, is that fair that both have to pay?)

etc---

Better be clear from start to avoid conflicts...

Interesting point, even though we thought about it, we didn't really agree on detail here. I think we would for sure have the 3rd party liability insurance which covers for driving other people's vehicles. In principle the person causing damage is 100% responsible for the repair + any subsequent insurance cost increases.

Interesting point, I would say it would be 50/50, as the person did not intentionally cause the breakage and was just unlucky to be the driver at the time of breakage.

Regarding the tyres I think I'm not worried, the car will be diesel and will have automatic gear box. Not exactly a racer car and one would struggle to abuse it. But a fair use clause would be in there I suppose to include things like not smoking inside and what kind of food shouldn't be cooked inside I don't want the camper smelling of fish cakes!
