Dash Cams - Are they legal?

Hi,

I was about to install my dash cam in my car, but then I thought about the strict data/privacy protection laws in Switzerland, and therefore my question...

does anyone know if they are legal in Switzerland?

If you don't publish the resulting images anywhere public, then you are OK. If you want to go public, you need everyone's permission...

But, the dash cam will probably restrict the driver's view of the road ahead, and that is illegal. The information is on this site somewhere, you just need to search.

Thank you for the info. It wouldn't restrict the view, since it will be behind the rear view mirror (I won't even be able to see the camera while driving).

Can I stop buying the vignette? Bloody thing is always in the way of seeing some traffic light, and I don't even have ten years worth on my screen as some do

I have a Viofo A119 which I'm really happy with. It's got a really nice form factor, slightly smaller than a pack of cigarettes, that makes the installation very discreet. If you buy it with the optional GPS unit, the camera itself is very easy to remove if you want to take it out of the car for any reason.

When we changed our GPS last month, we looked at a Garmin GPS that has an integrated dashcam and seems to have good reviews.

Bought another Tomtom.

I should have added.. I'm thinking of getting one because a while ago a complete f***** t*** reversed into me and then, of course, claimed I drove into them. It was settled as 'no blame' but cost me a grand as the excess to repair on my car.

That looks neat. Have added one to the car but looking for another for the damper so will likely go with that one.

Too much bad driving here in CH, wish I'd had a camera years ago.

Im planning also to buy one soon, and heard that its recommended to have one that can work (capture video) also during parking. just in case someone would like to kiss me...

Also, I wonder if I should go for a one side (front) camera? or front-rear will be better?

In December, I was putting my car through the MFK in Zurich, and the guy doing my inspection told me to take off my dashcam. I asked why, are they not allowed? He simple responded that this isn't Russia. As soon as the MFK was complete, I simple reinstalled it in the parking lot.

That one will most likely be illegal. While dash cams in moving cars is a gray area (there is no court ruling) running a cam in a parked car is most likely video surveillance of public places:

As said that is a gray area. You will find many court rulings including at least a federal court one about the legality of the surveillance of public spaces. But there are none about the legality of dash cams itself and if they have to be considered as private video surveillance of public spaces in general as the EDB /FDPIC claims. The above is so far the EDB/FDPIC 's personal opinion on the mater (Original by the predecessor Thr, but looks like Lobsiger has the same opininon).

Btw: There are three known cases where dash cam recording played a role in traffic cases.
In two of those it was used as evidence, in one it was not used as evidence.

I was not aware for this legislation in CH. Actually, if I understand the content correctly, it says something like "we know its not ok to use cameras, unless you do it within your own home, focusing on your own stuff. but since life is bit more complex than this, and we have to walk in the street from time to time without our eyes closed - we can't really enforce this legislation...".

There is a basic question of the intended use: are using it for stocking other people in the street? or do we use it to track someone who "kissed" our car, and easily show it to our insurance company?

anyway, I guess I can't change the law

Ill just buy one

Nevertheless, thanks a lot for the info. it is very interesting discussion.
