Second hand car - car is damaged

Hi All,

I have bought my car 7 days ago (BMW, 5 years old) and on Monday we noticed there is a stain under the car. The cooling system (coolant, the liquid is red color and a bit oily) probably leak and this could be a bigand very expensive problem.

The thing is that we bought the car second hand and without warranty (we made the contract where is written that there is no warranty). However, the thing is that we still have not registered the car and therefore we were not able to drive it. It means that this problem existed already before and that seller could potentially know that.

Now the question is what can we do here. Can we request that a seller takes care of that since we didn't even drive the car (which is obvious, i.e. it it not registered on our name yet) and that a seller should take care of that?

Every answer would be of great help.

Private sale? And did you buy the car as seen? Or did you take it for a check to a garage or TCS?

Was this a private sale, or a dealer?
Is the car parked outside? (Marder)
Coolant is usually blue or green. Red usually means power steering or transmission fluid. (BMW may be different)
What exactly does your contract say?
Have you called the seller about it?

It was a private sale.
We live in the city center and chance that marder did that is super small.
I checked and my liquid is red (pinky - antifreeze).
Contract say that there is no warranty. Car bought ab Platz.
I did and he said he can not help here.

Well, from the seller's viewpoint he sold it as ab platz. i.e. "Not in serviceable condition". Unless you can prove that he had deliberately misrepresented the condition of the car... you bought the car as is, no guarantee. That it turns out to be a car that needs work isn't his problem, that is how he was selling it.

How did the car get from his place to yours?
How much coolant has it lost?

He delivered it to our place. It has lost up to 2 dcl.

Im afraid it is your problem. As seen/ab Platz and no warranty. Unless, as JW said, the seller misled you by giving incorrect information (ideally in writing)

200ml would spread to a patch roughly 1/3 to 1/2 the size of the car overnight in these weather conditions on ashphalt or old weathered concrete. Are you sure?

When a car has sat for a long time without being run it isn't unusual to have cooling hoses weep a bit when it does eventually get started.

If you're parked on the street without a plate you'll get a ticket.

Presumably you were planning to have a mechanic prep the car for an MFK. Have you called them?

Unless a hobby-mechanic or for export nobody really buys "ab Platz" here.
I sold all my cars "ab Platz", it's clear they're broken and I never gave (or was asked) for details.

However, you could bring it to the official garage that did all the services. At least they know the car and can speed up the search for your particular - and any other - problems with the car.

It was mentioned up to 2 dcl. I do not know exactly because I am not at home today and I can not check the exact level of the liquid but I assume it continued to leak during the night.
It is parked on private property.
MFK done in April. Do they check such a things there?

It was bought "ab Platz" due to the fact we trusted this guy (i.e. know him from before).

The MFK only checks safety relevant systems, and that the car doesn't have signs of leakage.

They don't check how much coolant or oil or such is in the car. The won't even remove a cover to look.

5 years old, last MFK in April tends to suggest it's probably a minor issue (modern cars don't puke coolant, but still).
