Are dash cams legal in Switzerland?

I have a Swiss car and have fitted a front and rear dash cam. Simply put, I would like to know if it is legal or not? Also, in a crash situation, are they used as evidence here in Switzerland? I have read a lot regarding privacy issues and im just worried that Switzerland will be more conservative in their approach to this compared the the EU and UK.

Just looking for some clarification.

They are neither explicitly legal nor illegal.

There was a minor opinion from the federal data protection officer which said that if they record all the time they are not legal.

There have been court cases where dash cam recordings were admitted as evidence and also court cases where they were not admitted as evidence.

In view of those court cases the federal data protection officer has updated its opinion:

- Dash cam recordings cannot be used for entertainment purposes.
- Dash cam shall not be used to act as self acclaimed "traffic deputy sheriffs"
- Dash cam recording should only be used in serious traffic accidents

In the end a court will rule about admissibility based on the particular circumstances of the case.

Thanks for the replies chaps. So basically:

* Don't post the images from the cameras online
* Legally, it might help in a crash, but it might not!


How about in parking mode? The camera I have is a Thinkware that records in parking mode and has a light on the rear camera that I cannot turn off. I use the blue zone street parking. Could someone get annoyed that it is "invading their privacy"!?

FWIW there are a few thoudand Tesla cars in CH that have multiple recording cameras while moving and while parked, so you have company.

I believe it depends on how the video is used. If you post videos of drunk pedestrians on youtube, that would be illegal (without their explicit sober consent). But if you give the police a video of your car being rear-ended in the middle of the night that would be legal.
