Federal Court: Dashcam vid illegal and unusable

The federal court has ruled recently that dashcam videos can't be used as evidence in ordinary traffic cases. They're obtained illegaly, and ordinary traffic violations (including overtaking on the right and crossing a solid white line twice in the process) aren't grave enough to use the video as evidence regardless of its illegality.

Ruling 6B_1188/2018, it looks like it hasn't been published yet, at least I can't find the ruling itself.

Here's the communique. See partial translaton below.

The private dashcam recordings were obtained in violation of the Data Protection Act and thus illegal. Since the creation of recordings from a vehicle is not easily recognisable by other road users, it is a matter of secret data processing within the meaning of Article 4(4) of the DPA, which constitutes a violation of personality rights.

In the present case, the conduct of the motorist was qualified by the district court partly as a simple, partly as a gross violation of the traffic rules. These offences are infringements and misdemeanours which, according to federal court rulings, cannot be classified as serious criminal offences within the meaning of the Code of Criminal Procedure. The balance of interests thus falls out against the use of the video as evidence.

Very good decision.

We don't want a society where people can start recording each other and than send it to the cops to get the neighbour you don't like fines for relatively small things.

Bravo to the judiciary for having the farsightedness to see the end result of all these damn cameras. I also don't care to live in a nation of snitches and tattletales.

But it is good to see that evidence that these devices record of dangerous driving which causes accidents and injury will be accepted.

I am really reluctant to get one of these for my car but there are a lot of idiots out there, and there seems to be more and more every day. .

Just wait until these cams get connected over 5G, do ANPR and face recognition... it's not far from a technological perspective...

Then you'll be able to also track people you see every day on the road...

I've had one on my car for about 18 months now, very happy it's there. People soon back down when you point a camera in your car...

And it's funny that the TCS has just started selling them.

Way, way, way too many drunk drivers on the roads here and for me too much high risk (can't see oncoming traffic) over taking, i wouldn't hesitate to submit my camera's memory card when a drunk driver hits me head on.
