Re: Student, caught by police biking drunk with thc

By appealing the decision you will probably just create addional court fees. You should contact the authorities in order to find some kind of arrangement with them. Perhaps it's possible to pay the fines and fees in several installements.

Re: Student, caught by police biking drunk with thc

A fine of CHF 780 for riding a bicycle with BAC of 1.08 ‰ plus Cannabis consumption.

In canton AG, on a bicycle, that would lead to a fine of at least CHF 500

Stoned on a bicycle is also at least CHF 500

https://www.ag.ch/media/kanton_aarga...2019-10-01.pdf

Consuming Cannabis CHF 100 (Since January 2020 this is a fixed fine, which the police can hand out. Before that it was up to the discretion of the prosecutor.)

Not clear if your own bike was stolen, or you rode with a stolen bike. If the latter add CHF 200.

Aggression against police officer, hindering police operations, etc. would not lead to a fine but to a monetary penalty. With out knowing the exact wording of the letter specially all the Art. XX Abs. YY mentioned I assume this charges were all dropped. Getting cuffed has no negative effect.

All is summed up, and as we are not in the USA some rebate is given. If you object solely against the fine you might be lucky and get it dropped a bit but under CHF 500 is very unlikely.

The Auslagen of CHF 1283 are the police and lab fees. Difficult to get this lowered.

The Abschlussgebuhr of CHF 200 is the lowest possible. Nothing to change here.
https://www.gesetzessammlung.bs.ch/f...ith_annex/3881

Be aware that if you object and lose your case you will be hammered with court fees.

Re: Student, caught by police biking drunk with thc

I've been so drunk so many times on public transport but being friendly with the police. I've seen some guys much less drunk than me argue with the train staff or the police and it doesn't end well.

A 2000 CHF fine seems high but it's not unusual in CH. An acquaintance lost her driving permit for 3 months a larger fine for a similar story about riding the bike while drunk and scratching a police car with the bike handlebars.

Ask for smaller monthly payments, not much to do.

Haha, not a nightbus rider, right? I've been wasted to the point a police office helps me to buy the ticket in the automat, then ask me where I live, then tell the bus driver "please drop him at X stop". How you talk makes all the difference.

Why, would you prefer to pay more? Talk to mum and dad, borrow the money to pay the fine and accept that you will now end up on the Schengen system as a criminal.
In what statement did i wish to pay more? Im definelty going to pay but i wish to know if a written appeal (as they stated i have a right to do so) would help in any way to lower the fines, or if there is a risk to make it worse for their byrocracy work etc

Sir / Madam, whatever. You have received extremely good advice, free of charge.
That's a rarity in Switzerland.

You come from an equally amazing country (plus or -), and are fortunate enough to be in a position where you can study abroad. So really you know that you should have known better.

But don't beat yourself-up about it. We have all made stupid mistakes (I challenge anyone to deny that), and now you need to live with the (expensive) consequences. You'll know better in future, that's just the cycle of life. None of us are angels (as far as I know). But if you fck-up again, then you know how it can turn-out.

I think what they want to say is if you appeal and the the decision is upheld, they'll charge you the costs of considering your appeal. You need a good reason to appeal, such as a technicality which probably only a lawyer could help you with. Then you pay one person instead of or in addition to the other. If you would get a criminal record it might be actually be worth consulting a lawyer to try to avoid that.

Well as a classical music student you should know when it's time to ......

face the music

BOOM!

can't believe no one else said that. Apart from offering poor humour I can only agree with the general sentiments, you screwed up, it won't be the last time so let yourself off the hook and pay up. Did you say it can be paid in installments? I wouldn't stretch this out by appealing tbh, best to get it over and done with and wait to be mocked mercilessly during the speeches at your wedding.

Under no account try to deal drugs to raise money to pay the fine.

As Basel student they should have known that the only accepted drug for bicycle trips is the classic LSD.

@kokolele If I am not mistaken the verdict has been sent by the prosecutor/state attorney and not by a judge/district court.

In this case there is an informal way to object or at least inquiry further information. Just call them and ask them how he came up with the amount of the fine and how it was possible such much fees are charged, and if there is a possibility to lower them.

Also there are ways how you can pay in installments.
https://www.stawa.bs.ch/strafbefehle.html
and
https://www.jsd.bs.ch/ueber-das-depa...verfahren.html

It could be that you can only get a payment delay for the fees and the actual fine must be paid in one initial single installment.

Can you not just use a credit card? Or get your parents to use theirs and you pay the instalments? At least then your dealings with the Swiss system are over and done with.

And thanks for posting your experience. I'm an occasional drunk rider, when I do occasionally go out, so it's a nice reminder of the penalties involved.
