Student, caught by police biking drunk with thc

Hi,

Im a former student who lived in basel to study classical music. recently ive been caught by the police for the first time in my life and i want some info(i do not seek any pardons as i know my actions were not ok)

So, me and my friend was at my place for some chill time 16th of may 2019.
We were bored and decided to go to a club around midnight nearby (wich was located 5mins by bike away)
It was kind of a night were we wanted to find some fun in town. Happens it escalated to something very bad.
We were drinking (4-5 beers) and smoked some cannabis inside the club, but it turned out to be quite boring so we decided to go back to our place to chill further and play some videogames before we sleep. The time was around 03.00. We came with bike and stupidly enought, we did bike without any hesitation.

on the way home (1 block away from my appartment) a police car stoppped next to us and told us to stop biking and walk. This was a warning and i assume they noticed us being intoxicated with alcohol. But we felt we were fine with the balance(not trying to excuse myself here). 1 min later the same police car drove back to us by driving around the block and found us again on the bike. This was very stupid of us. it was very close and we just had to walk few meters to arrive home. Ofcourse now we were in trouble. They checked our alcohol promille (i had 1.08) and they started to do some paperwork. Ofcourse this was hopeless, and ive never been caught before. with the alcohol in my blood, i was feeling really bad about this, how unlucky i felt, and how stupid i was. But i wanted to somehow have my rights on this because it was first time i got caught and i knew little.

I asked (wich i shouldnt have done) about what fines i would get. They didnt answer and they didnt want to tell us how much it would be. As it seemed they didnt want to inform me anything, i started to kind of show some disrespect to them, i regret doing so, and with the alcohol i felt more and more afraid wich caused me to start talking more and more.
Time went by and we stood there in the cold for almost 1 hour.I started to ask if it was alright for us to take our phones. Further more stupidly asked if it was alright for us to film the procedure. There were 3 police officers, 2 men and 1 woman. The woman was quiet and stared at us thru the whole process with an angry face right pointed at us.
I put my hands in my pocket and she told me to take my hands away from the pockets, i did as she told us, it was cold. She told us that i might have a weapon in my pockets, wich i thought was ridicilous and told them that it ws freezing. I started to be verbally quite defencive(offensive depending on how you see it). Wich seemed to made them more hostile.

In the end they got tired of my behavior and cuffed me. i did some restraint because of the surprise. I started to cry and told them this isnt right.

next i was in the police station and they did more paperwork, i sat down quiet thru the whole process and had to go thru bloodtest balans test and urine test. in the balance test i had no problem. They asked me to sign a paper saying if i agree of guilt. it was on german and i said i cant sign something i dont understand. the time was 05.30 and my bike was stolen. the friend i was with got only a fine for driving drunk only.

Time pass by and i moved back to my homeland Sweden, but i got a fine of total 2263chf with the crimes i had done in german wit the right tohave a written appeal sent to my nearest postoffice. As it seems they wrote as if i was aggressive and not willing to cooporate.

so, this is really embarrassing situation. Ive contacted my lawyer friend and we are trying to find a way to reduce the costs but it looks like im in trouble.
I cannot afford at all to pay this money, and they said it can be payed seperatly.

I have some questions

Have anyone gone through these kind of situatuions in switzerland?
What options do i have?
My lawyer friend told me if i could ask for an english version and also the specific cost information. it seems like they do not provide an english version.
Can i write the written appeal in english?
Everything just seem more difficult because of the language barrier.

Ive learned a lesson, ive never been a person who is aggressive physically.
I have only 10 days to pay the fine or send them a written appeal only by post.

They were nice to you the first time by giving you a warning, you still did what you wanted to do and now you have to pay the consequences...simple.

Please don't ride drunk, it is dangerous for yourself and others.

Fixed that for you. They were already not well disposed to the OP when he ignored the warning.

Just wondering. If he doesn't pay the fine obviously he'll have to stay out of Switzerland forever, but any other consequence?

depends if Sweden have any agreements with Switzerland

You might got a bill over this amount, but the actual fine is much smaller. The rest are court fees, police fees, lab fees, etc. etc.

So how much is the actual fine ? And what is the actual sentence: is it just a fine (Busse) or suspended monetary penalty (Geldstrafe) plus a fine (Verbindungsbusse/Busse)?

Just for future reference: The police does not know the answer. There is no fixed fine for drunk driving. A prosecutor/judge will decide how much it will be.

Send the paperwork back but fill the envelope with 500g of glitter. Don't fill anything else out. I wish more people did this to the jobsworths of the world to brighten up their day!

Is Swiss law enforceable in Sweden for this offense? If not, don't return to Switzerland.

Really wtf 2,200chf for this? Admittedly the police were semi inconvenienced, but they could have decided to look for more effective uses of their time?

Just for future reference: The police does not know the answer. There is no fixed fine for drunk driving. A prosecutor/judge will decide how much it will be.

Abschlussgebuhr: 200chf
Auslagen: 1283chf

I will pay ofcourse, was a childish behavior from me. but i want to know if a written appeal would help the fine costs, i just want to cut the fine if its possible.. kind of impossible for me atm to pay this

Why, would you prefer to pay more? Talk to mum and dad, borrow the money to pay the fine and accept that you will now end up on the Schengen system as a criminal.
