Outcome of story - spoke to the seller and he returned my reservation of 2100-. Told him I am pissed off and he had no chance in court but decided to move on and get another car, in a month or so

I think it's a good outcome for you.

You could have forced him to sell, but then you could have received the car without the full service you expected, or with empty tank and second hand tyres... My point is, even if you were legally right, this is likely the solution that now minimizes your overall losses.

You'll find another car and you will have fun with it and he will be offered 19.000 CHF by the next customer...

If he still has the car in a few weeks send in your partner or a friend and offer 1.500,- less than what you initially agreed upon.

Generally you would expect the seller to pay an extra 10%, the amount you would have lost if you had not got ahead. I would push for the 10% & issue a betruibung for the amount if not paid in 14 days.

This demonstrates why one-sided deposits are to be avoided at all costs, even more than the plague.

Just imagine your nightmare if he had refused to return the deposit.

If one is necessary make the deposit the same for both parties, to be paid it into the same escrow account, and if either party fails to fully deliver on time the entire account belongs to the other party.

You have the right to be paid for any damages you incurred, but no more (the burden of proof being on you). Except, of course, such was contractually agreed, which would bring us back to deposits for both parties.
