Legal Tyre usage


I'm new in posting around here and have a question that I couldn't get clear from a topic back in 2009(!?)...

Here is the riddle.

Own a JCW from December 2017.
Original "allowed" measures for the tyres stand as:
205/45ZR17 in 7Jx17 ET54 - Factory size
205/40ZR18 in 7Jx18 ET54 - Current install option from BMW

Would it be legal to use a rim WITH CH-Zulassung in:
7.5 x 17" ET35 with 215/45 ZR17

this would mean 1.5% more on the diameter.

So the questions.
Is it legal in a Police detailed control?
Is it legal to take it to MFK?
