Had 3 x same "Verbot fur Motorwagen" fines 3x violation in 1 hour time

hi All,

Just recently, last weekend, we were driving in an area which we were not very familiar with. it was a Sunday. after a week later, we got 3 x 100 CHF fines, for exact same rule. For getting into a road of "Verbot fur Motorwagen". apparently, we got into the road 3 times in an hour time (like at 16:02, 16:35 and then 16:49), thus the three separate fines. I know we were very careless and stupid. no idea how we missed the sign 3 times in a short time period but at the end happened.

I wonder if we have any right asking to pay only 1 or 2 of these total same 3 penalties arguing that btw second and third entries, it was only 14 minutes difference. Did anyone experience this kind of situation?

We had a talk with the police thru phone and as expected they said they cannot cancel any of them but I still wanted to doublecheck with this forum if anyone experience sthg similar to this.

thanks in advance,

Re: Traffic Offences - Q & A Bullet points

Presumably there was a camera flash that recorded this. Also do you have the coordinates on Google Earth to understand the situation??

If this was 3 separate times you were on that road, no.
It is 3 offences.

yes, looks like this is coming from the camera. on the fine, they say the pictures are available but they did not send with the fine.

on the coordinates, no but they show which street it is etc.

Re: Had 3 x same "Verbot fur Motorwagen" fines 3x violation in 1 hour time

I'd suggest to pay it quickly and stay under the radar as this may be under public offence criteria since it may look like you deliberately broke the rules and that may be very expensive inclusive loss of driving license etc

Visit to the police and explain the situation before paying may do good to explain what happened and question visibility of the sign perhaps without pushing on refusal of payment - worst case you be sent for eye-doctor check , best case he/she may take your case and request check of how the sing is positioned as it may be someone has simply done something to it and you had no chance to see it.

I had similar 2x red-light on same place issue back in time - done as above - paid the fine - all went well - and done that on advise of Swiss policeman as simply he has seen it way to many times careless youngsters driving rounds on their weekend-polished Golf GTi and as policemen he wouldn't care less to make sure it doesn't happen anymore where he's responsible for - until there was good explanation.

My was - 2am weekday , 200msec on red - could see it just changed red when my car was half-way over the lights .with 40kmh.. in two consecutive days until I learnt yellow lasts just 3-seconds and goes red.

That only works at school, then never again. You misspell a word consequently it counts as one mistake.
Later in life you get punished as often as you repeat the mistake.

They would also argue that if you were unfamiliar with the area (e.g. looking for a certain address) you would go slowly ergo you would have seen the sign - at least the second time.
Plus, "Verbot für Motorwagen" would be this one?

That looks pretty international to me. You might risk having to be "reeducated" if you complain.

I guess there's no way out of it. Just for curiosity, how were you caught? Automated camera? Police officer having coffee roadside and taking notes?

That police officer probably went home totally baffled.

Or he sipped his coffee thinking "did that guy just drive through the driving ban? Naaa, I must have .... well, he's doing it NOW ..... (third time:) what the heck ...."

Some roads with a ban for cars get used to bypass bottlenecks elsewhere. In others, the ban is commonly ignored, for instance the ban west of Zürich's Langstrasse during night hours.

The automatic camera west of the Langstrasse recognises the plate numbers of those with the right to access, the others receive a 100.- fine each time they pass during the banned hours. In one Saturday night, possibly when it was introduced, it issued 250 fines, nicely demonstrating the necessity for actual checks.

Okay, this is nasty. It looks like one needs to be aware of the street-name as well as the house-numbers (stretch of the street) it concerns.

When in doubt - and here I probably would be - I just take an other way, to be honest.

Re: Had 3 x same "Verbot fur Motorwagen" fines 3x violation in 1 hour time

This new type of camera that automatically registers number plates without privileged access has also appeared in Collina d'Oro (near Lugano) to stop non-residents from transiting through. For now there are only x2 cameras recording trespassers in Via Civra and Via Risciana and each contravention results in a 100 CHF fine . If residents expect a worker or visitor they must notify the municipality 48 hours in advance otherwise the fine is payable.

Both areas are marked with:

with a 'except for municipal authorization' note below.

The whole area next to Grancia is also restricted to non-residents but whenever the main road is blocked people use the parallel road as a shortcut. No cameras there... for now.

That's ridiculous! Kills all spontaneity! Who wants to live like this.

When I look at the form, it's still ridiculous! LOL. What do they need all this info for?! Numberplate ZH-000000 was okay to pass on May 3rd should be plenty enough!

edit: Streets no fully paid and maintained by private people should not be closed to the public! And such private streets should not be protected by the tax-payer (police plus all the gadgets they install to do it).

Have to give the OP some forgiveness. Those signs seem to be a bit outdated and confusing. I mean is that really a car on the sign. Looks more like a Smiley tank. And that other thing below it, is that some kind of steam propelled bike?

Agreed. Plus I was thought to watch the traffic and not study maps and comics while driving.

Okay, no traffic to see in those roads should clue me. But that will be too late.

That looks pretty international to me. You might risk having to be "reeducated" if you complain.
Except it's not something you'd see in the USA so most Americans would not know unless they'd studied in advance. We like to spell out our signs for some reason:
  • Do not enter
  • No through road
  • Pedestrian traffic only
  • Speed limit XX mph
  • slower traffic keep right
  • lane ends, merge left
  • bridges may be icy
  • heavy traffic ahead
  • right turn on red when safe
  • no right turn on red
  • no U-turn
  • left on green arrow only
  • road closed Fri 8 p.m. - Mon 5 a.m. for construction alternate route via hwy 55
  • Amber alert: 5 yo child, Black Ford sedan Lic #XYZ-123. Call 911.
etc. etc. You're past the sign by the time you finish reading it in some cases.

If people think it's hard to watch for signs here, try there.

What I mostly miss are the warning signs for curves. Especially when driving down a road for the first time. In the States it is posted how fast one should take a curve. In Europe, if one is lucky, there is a bunch of big white arrows but no recommended speed making a first drive a guessing game.
