Caught driving with expired UK License

Hi all,

First of all I know I've been stupid, but now I just want to know what punishment is appropriate.

I was stopped by the police a while ago at the AT/CH border. The border control checked my driving license and noticed that it expired 10/2019 (I know it's not an excuse, but I actually had no idea. I passed my test in 2013 and I thought it lasted for 10 years but apparently not)

The border control called the police, and they came to check it out. He said he thought it was fine because it was only the card that expired, and my actual drivers license is valid until 2060-something. However he took my details and I went on my way.

A few weeks later, they called me to come in for an interrogation. I tried to explain that I do have the right to drive, never had any penalties, but my photocard did expire and I didn't realise (not sure if this makes any difference).

The police said that now it will go to a prosecutor, and I will receive a fine which I can contest. Since then I've got a bit scared reading that I could be subjected to a daily-rate of up to 3000 CHF for 360 days, or even a 3 year prison sentance.

Like I said, I know I'm at fault, but I feel like driving with the expired card is different to driving without an entitelment, and I'm worried that it will be treated as such. I have also only been in Switzerland for around 9 months, and I will leave the country next month so I didn't intend to change my UK license for a Swiss one.

Does anyone have an experience like this, or could provide any advice?

If it were the UK you would probably be able to get away with it. Unfortunately the DVLA website states that an expired license is unlikely to be accepted aboard. Switzerland is a stickler for rules so you can probably expect to get a fairly hefty fine.

It should be valid for 10 years. Very odd that it’s not.

Maybe you could contact the DVLA and ask why. If they made a mistake, maybe they can some how get you out of it. DVLA should also have sent you a letter reminding you to renew. You might want to ask why you didn’t get that .

I happened to mention this to an Irish solicitor friend of mine... he said it was probably a good idea to seek legal advice before admitting to driving around the UK on an expired license as that may come with itís own consequences!

I'm guessing that the validity runs from when it was first issued as a provisional licence and that the date doesn't automatically get reset/updated when you pass the test, just like it wouldn't if you changed address.

It was one of the annoying changes that came along with the photocard licence - before that the plain old paper licence remained valid until your 70th birthday, afterwards the licence entitlement would remain but the physical card needs updating, new photo and all, every ten years, just like a passport.

I believe you can't exchange an expired licence anyway, you'd have to renew in the UK first.

Yeah, it's a bit of a catch-22. I've often pointed out that although some people regard that sort of "white lie", i.e. pretending you live in one country in order to gain some advantage from it, as not really bad, there can be significant legal consequences in some cases. Much more so if it's affecting your insurance or import/export of goods.

But in the event of needing to renew the driving licence before immediately swapping to a Swiss one I would think any such consequences would be minimal to non-existent and it certainly wouldn't be an issue for the Swiss to exchange it, just because the issue date overlaps with being resident here.

The Swiss give you one year from entry to change your UK driving license for a Swiss one - it's not clear from your original post but if you have been here longer than 12 months then they might also pick you up on this transgression too.

I know someone who swapped his UK license after 5 yrs here with no ramifications but you might want to think about how you spin this too if needed.

Thanks for the responses guys. I have actually already renewed my British license, I spoke with the DVLA on that one.

Now the biggest concern of mine is the upcoming fine. Based on the daily rate and the maximum of 360 days, the maximum fine is more than 50,000 CHF..

It's unlikely but if it's anything close to that I just can't afford to pay it.

you won't get maximum sentence - no worries - this is for guys that want to say they are 'above the law' and would gladly pay 1k CHF each time .

Go and explain that you were not aware and didn't intend . Now should you be swiss resident - you should have changed your driving license in 12-months after arrival and that may raise concerns .

for not changing and driving on (valid) non-Swiss license it would be 100-200 (I paid 100chf -20years ago).

Driving with expired license shouldn't be that expensive as it's not your license was revoked or made invalid - however whenever renewal in UK requires eye-check or so - that may be seen as you did not meet required qualification of your country - and raise concerns.

Going to police and explaining should work just fine - being honest may help - not necessary volunteering too much information .

The fine will be nothing like that.. People get a couple of grand fine and banned for a few months for excessive speed in built up areas which is classed as being really really bad.. I'd be more leaning to a couple/few hundred, maybe plus admin costs, max 1k total? but who knows..I'm guessing of course,

I have no idea when my UK license expire(s/d) .. I exchanged it here in 2012 but i'd had for many years before that.. The CH one has no expiry i believe.

indeed this is an administrative issue. Because it went to some kind of judge then you will get a fine plus some costs. Be prepared for the costs potentially to be greater than the fine.

The question you should be prepared to answer is why you don't have a Swiss licence. You are resident here and driving a Swiss car, correct?

Because you have 12 months to swap it, they are staying less than 12 months, so they don't have to.

If you are in possession of a new photocard licence which has the original issue date you could use it as evidence you do/did have a valid licence, but it might be too late for that - even if they deicde no real offence committed there may well be admin costs.

Some driving bodies advocate not having your licence with you when driving in Switzerland. The fine for not having the licence with you can be much less than the consequences of having it with you. Of course you will still need to produce it at some point.

Thanks for the reassurance guys. I really hope it doesn't turn out to be a huge fine. It's just the waiting that bothers me.

Yeah as mentioned I didn't change my license because I knew I wouldn't be here for more than 1 year and therefore I didn't need to.

So well within the 12-month range. Sounds to me like you were permitted to drive, but just didn't have the paper evidence on you. Not sure how that's legally different from driving while your paper permit is in the office drawer, which costs 20 CHF, perhaps a bit on top for crossing the border plus an Austrian fine - nothing sounds like it would cost a small fortune. But that shouldn't go the attorney general, maybe the police aren't sure either and playing it safe.

If possible, it may be useful to get some kind of written statement from the UK confirming that you've been allowed to drive since 2013 without interruption, and that the new paper you now hold is just a renewal.

Well Smith, I have no real advice. But as an expat and someone who just converted license, I just want to share my empathy. I think it will be fine. Swiss police are often reasonable and from your case it looks very obvious that you had no reason to flout the rules. All the best! It will be fine.
