Somebody should pay that CHF4000 damage. Insurance companies gladly collect the high premiums but there is like a forest of hands raised up (not) when it comes to claim repayment.

If the garage was negligent to assure protection on their side then they didn’t check the weather forecast. They went to watch Euro2021 last night, came back this morning and said oops shit happens

This is not the end on the story…
I would suggest that this is key... you left the car under a cover, and they moved it...

Do you have legal insurance? I would call them up to pursue the dealer...

How can they not be liable? The damage is a direct consequence of their action!
It might be a different thing if they hadn't moved the car, but as you describe it ... their refusal makes no sense.

Sure and if the OP has a decent level of cover then it, then their insurance will, BUT there is an excess to pay and a fault claim registered against them. On the fact pattern shared, it’s on the dealer and amazing that they would kill a relationship and a sale over this. I can only assume that with so many cars damaged, they have a bit of an issue, as they probably can’t get (or can’t afford) hail protection for an open car lot.

Could you tell us which dealer is this so that we don't accidentally go near them?

Absolutely. You (or better, your insurer) should be able to make a case that the action of moving your car from under cover into a forecasted storm was an act of negligence. Furthermore, without signing a disclaimer to the contrary you had a reasonable expectation that you were leaving your car in their safe custody.

On the point of legal insurance, you shouldn't need it. Your car insurer will seek to recover the claim costs plus excess themselves.

I was thinking about a dealership in Oftringen after reading your reply. At least a dozen brand new ones in the photo and at least 50 used across the street.

I made my best effort to not laugh when the sales guy asked me with a straight face if I had covered parking at home and in my office for insurance quote
purposes.


As eyebee mentioned, I guess the dealership manager is in deep deep sh*t and not thinking rationally today. Abfab, get legal assistance in the mean time and be more prepared than the idiots. You don't have to fight perfectly, only marginally better than them.

Sorry about that experience.
It naturally feels, that whenever a business or a person is entrusted with a property, it becomes responsible of its safety. Unfortunately, it is usually not the case IRL, due to lots of small print or lack of proofs. Hopefully, you'll have proofs and a case.

Basically, the car is your property and the damage was done due to an "act of god" hence your damage and your insurance that needs to cover it.

Did the dealer act negligently? Considering that he has a lot full of cars and likely treated your car in the same manner has he treated his own cars, it is doubtful.

The dealer moving your car from a covered place to a non-covered place will presumably not be viewed as negligence if the covered place was for temporary parking (as is the case at my dealer). In this case moving your car would have been normal business.

It might be different if the dealer - in light of the hail forecast - decided to move his more expensive cars under cover and moved your car out to be exposed. In this case one could argue that the dealer intentionally exposed your car to a higher risk, and did not actually give your car the same measure of diligence as in his own matters... (whether that actually gives rise to liability is an interesting question). Did you take a photo of the car that was under the cover after the storm? If it is a Lamborghini you might be on the right track...
