What's the deal?
You should have stopped. If you saw the yellow too late you may have been daydreaming or were too fast.

Standard is an anonymous fine (Ordnungsbusse) of 250.- according to Zürichs police, so no further consequences. But as you say it was icy and were unable to stop in time, it may well mean you were driving too fast; not above the speed limit but considering the circumstances. In such a case the sanctions may be quite a bit higher and will usually come with a temporary suspension of the license (I would expect one month if there was no danger of actually hitting something).

I was flashed by a red-light tonight. It's pretty wet/icy here in Ticino tonight. I'm from the US, and its advised and taught that if you're going at-speed (not speeding, but normal speed) and the light turns yellow that you shoul proceed through the yellow. Abruptly stopping in traffic at a yellow can cause accidents, as well as additional danger when the road conditions are not 100%.

I saw yellow when I went through, and caught a glimpse of red as I was under the light. Seeing as there was no earthly way for me to safely stop before it turned red without adding risk to myself or people around me - will this get me fined?

It kind of shocks me how short the yellow lights are here. Should I be stopping dead when I see it go from Green to Yellow? Should I hope that the people behind me are always, 100% paying attention and, too, will slam on their brakes just as I slam on mine? It seems like I'm choosing between a definite fine, or possible accident/death.

What's the deal?
If it was around a second between the change to yellow and you passing under it at 40-50km/h, there should be no problem. I did it several times and got no fine for it. If you see red then sorry, but yellow is for 5 seconds and that gives you a lot of time to brake safely (a bit abruptly but still safely).

Re: Traffic Offences - Q & A Bullet points

What has US traffic law got to do with Switzerland ?

You were driving too fast, couldn't stop SAFELY, tried to beat the light and got caught.

Pay and shutup, you haven't got a leg to stand on

Re: Traffic Offences - Q & A Bullet points

Hello all,

I just received a letter from the "Staatsanwaltschaft" stating that I am guilty and that I have to pay a fine and will have a probation for two years for overtaking from the right.

The letter doesn't say anything about having to hand in my licence.
Does anyone know if this is the final verdict and that means I don't lose my licence or will I receive another letter about this?

Thank you
Petra

The prosecutor has no decision about revocation of your license. In the letter it is also stated that a copy went to driving license authorities of your canton.
They will decide based on judges verdict and circumstances. As you said in the other thread you were sentenced with 40-daily fines on probation , hat means the sentence is based on Art. 90 Abs. 2 SVG. In this case the driving license authority has not much leeway and must issue a ban of at least 3 months.

Thank you
Are how does it work with the deferred penalty?
Can I choose to hand my licence in later and how much can I push it?
Your help is much appreciated

Petra

Simply be nice. But you will have to pay the court cost an the associated fine.

No. Therefore you were either speeding or it was red.

Cross your fingers it's the former.

Definitely not going fast enough, i had to use my brakes because there was a car in front of me, and i was passing the crossroads when the traffic light was amber. Will see in the near future.
