Tax issues with car import

Hi all,

I just went to the customs to import my car. I bought my car from my parents in August 2009, moved to Switzerland in October 2009. I need to import my car within 12 months, which I decided to do know.

Since I own my car for over 6 months, I thought I would not have to pay any import taxes. However, the customs guy says I would need to pay anyway, since the date on my permit B is less than 6 months after purchase of my car.

Is this correct? Shouldn't the customs look at the date of declaration (April 2010) instead? If so, what would be my options? The customs guy says I would need to have the value of my car estimated by a local dealer, and pay an import tax of 10-12% on that value. That would be quite expensive!

Im afraid the tax guys are correct.
You could drive in the car in CH for the first couple of month, then bring it out of the country and back in again, importing it after driving it here for 4 months.
I am quite certain, that for that reason, they consider the date of your permit as the import date of the car.

Ok, in the case I would need to pay import taxes, what would be the basis for the tax price?

The purchase price, or do I need to let the value of the car estimated at a local dealer? In the latter case, could I manage to suppress the price as much as possible, or would that cause problems? Anyone having expertise with this?


There's no waiving since I bought the car from my dad?
Another attempt to circumvent taxes: does the date of registration of the car count, or the date of purchase (invoice date).

Do you have a receipt from when you bought your car? When I took our car to the customs office (in Zurich) they asked for a receipt to find out how much we paid for it, we didn't get one (private sale) so they looked on the swiss version of autotrader for cars similar to ours (ours wasn't sold much out here) and they worked out from that how much the car was worth. Unfortunately I can't remember how much they charged us in taxes.

Also, unfortunately, yes you do have to pay the taxes, they do work out the time of import from the date of your permit.

Ok, well, I bought the car from my dad. But there is an invoice for that, since it was needed for my dad's accounting. The invoice amount was quite low, so if they accept it, I might be off reasonable.

Now I wonder which date the customs look at for the beginning of the 6 months period. If that would be the purchase invoice date, rather than the registration date, that would be beyond the 6 months and the import tax could be waived.

If anyone could confirm that the purchase invoice date counts, and could back it up with an "official" reference, that would be great! Then I can back up story next time I run into a discussion with the customs guy.

As far as I know it is from the purchase invoice date, but I'm afraid I don't have any official references to back it up, I'm sure someone will be along shortly with something.
