I've just received a parking ticket as described above. Number plate is right ( it is my number plate ) but model is wrong. Toyota vs BMW - not even vaguely similar. Problem is, the infringement is from 10 months ago and it wasn't me. Yet this is the first I've heard about it.

How do I know it wasn't me?
1. Occured Saturday morning at 8.30am on the other side of town. I never get out of bed that early on a Saturday. And I never drive when I'm out on a Friday night.
2. It was a residential area I have never been to, nor would have any reason to go to.

If it was 40chf I could probably overlook it. But this is 120chf.

Any advice... ? In particular how I can possibly prove I was at home sleeping almost a year ago? Do they have to take photos at the time. And is there any truth to having to pay for investigations?
That is a tough one. Obviously the first ticket wasn't paid, maybe the driver refused to pay as the car description is wrong. Do you sleep with married women? That would explain the mix up if you were shagging a policeman's wife...

Best advice: pay up, unless you have some very good evidence, because if you go to court and lose, you are looking at a parking fine of CHF 120 plus costs of hundreds more!

no, i agree with him 100%

if authorities want to fine people for infringements they have to ensure its own regulations and laws for enforcement are followed EXACTLY, many fail to do so.

thats fair game in my book. I have not had any tickets here but have had about 7 or 8 in the UK - i have appealed every single ticket and won each one at adjudication.....

why? because the councils have not followed thier own regulations due to signage, councils issuing tickets they are not authorised to do so, tickets with defective wording etc...

if the ticket is incorrect thats not my problem.

have you been to the police station to ask.....

why has it taken so long?

is it the same car model?

is it the original ticket?

it is not unknown that incorrect plates are entered

There's no morality behind the story. It's a mistake from both sides not one, so why only one party pays?

You don't need to do much but just write a letter to them explaining that it was not you and it's not your car.

I think you need to replace women with men... and wife with husband. Although I spose technically your original comment could still apply to me

Correct tag number = pay fine
Problem is, it is my tag number, but it's not the correct tag number.

So why would I pay a fine that isn't mine? Yes I know the answer. Fear... fear of a 500chf fine instead.

I've been trying to call them for the last couple of days, to see what I need to do to contest it and whether they can provide the original report or photo or some other info. But the phone rings, says to hold, then hangs up. Will try again, and if no answer will have to resort to going down there. Why is it that institutions can charge admin/late payment fees, but the public can't charge a "waste of time" fee?

What a fantastic money maker. Send bill, refuse to correspond with billee, and if they don't pay bill increase bill. Repeat cycle.

Re: Parking fine with wrong car model

A simple parking fine is CHF 40,-- but stopping in a dangerous place, ie parking in a prohibited place, would have a higher fine of CHF 120,--

Look at penalties 207, 208, 209, 210, are you accused of one of these?

http://www.admin.ch/ch/d/sr/741_031/app1.html#ahref0

With the long time lapse I would suggest sombody received a ticket and argued that the car model was correct, but the number plate was wrong. And now months later they are trying to hang it on you.

I would now write to them, objecting and pointing out the car make is wrong and you were in bed at the time. If they don't accept this and summon you to court, the penalties increase mightily, so if you are summoned I would pay the fine quickly and avoid a court appearance.

A problem is that this might not be a simple parking fine, but stopping and causing a dangerous traffic situation (What does the ticket actually state?) and if you are unlucky they could put a black mark against your license.

.

Re: Parking fine with wrong car model

It's for the following.
241. 1.
Stationner sur une ligne interdisant l’arrêt (art. 79, al. 6, OSR et art. 19, al. 2, let. a, OCR) jusqu’à 60 minutes

Ive never had a parking or speeding or any car type of fine so far since living here so no probs with black marks adding up.

Do you know what the situation is with taking photos. Do they do it here?

Re: Parking fine with wrong car model

No, they won't even admit to taking a photo, as it is illegal.

So it's a parking on double yellow lines crime .....

Parkieren auf einer Halteverbotslinie (Art. 79 Abs. 6 SSV und Art. 19 Abs. 2 Bst. A VRV) bis 60 Minuten

and this will not have a bearing on your license!

Parisblue: I was referring to the initial post. No groan required. IF THE TAG IS CORRECT PAY THE %&ç*/ FINE. Unless there is a picture available to prove otherwise (in any situation) there is no way to overturn a ticket in this country. Been there, done that.

Thanks for blemishing my 0 groans stat: now I have one, thanks to you.

There was reason for the first groan, and now the second. Mostly because you are talking bs. How do I know this? My ticket got wiped

So you clearly don't know as much about tickets as you think you do.

Also if you are going to comment on posts, at least read the basics. Eg. the date.

Re: Parking fine with wrong car model

Interesting situation. I would probably just pay up because you admit wrongdoing. And I do believe in karma. I had a situation about 7 years ago where I got a fine from another town for parking. I think they did have my plate number right but I had never been to the town! My Swiss colleague made a call and wrote a letter and it was all cleared up. Getting off on a technicality is not cool in my opinion. It will catch up with you eventually.

My comments were related to the 2 times I received a ticket, one of which I felt was given unfairly. The response I received was if the tag is correct then I should pay; if there is a picture available then you can dispute it. Even though there was no photo, I did dispute, but to no avail. I had to pay. I don't "bs".
