Re: Private parking - warning or what?

A nice overview of what you can do:
http://www.hev-zuerich.ch/ms-zeitsch...-200410-17.htm

In a nutshell, if its your parking space (either you own or rent it) you can have the car towed. Th only problem is that you have to pay the towing company and then have to recoup your costs from the person who parked in your space.

If you are renting the space, you can probably get the landlord to take care of (i.e. pay for the towing), since he or she has to ensure that you can actually use the parking space for the intended purpose.

Some enterprising companies or people try to collect a "private fine" (usually by slipping an orange postal slip behind the windshield wipers). While you are in your rights to claim the costs associated with the parking space being blocked (ie. towing company, assumed benefit of a parking space, costs of replacement parking space, maybe even adminstrative overhead), they can't actually collect any "punitive" amount.

If it is a recurring problem, you can request that a "richterliches Verbot" (judicial prohibition) be issued. You will probably have seen signs, saying that "this is private property and trespassers will be fined CHF XXX." There is a procedure involved in getting such prohibition and the sign needs to be posted. If someone then still decides to park in your space, you can call the cops, and let them issue a fine, which will go to the Canton...

Still, what about this "private fine" thing? Can you be fined somehow by the owner of the space?

And a somewhat related question: how do you know if you're allowed to park in the street or not? I know in busy areas there are the coloured zones, but in villages or some normal (not big) cities, there are no markings, especially in the residential areas, and there ARE cars parked. Can one just park there beside them? For example, on my street there are ALWAYS some cars parked in the street. Also, I've been in Aarau and left my car parked for a whole day in a residential area near a hedge, fearing I'd get a fine or something. When I came back there was no fine and some more cars parked alongside
You get a warning first - usually - that`s how it operates in my small town. Here, we have learned, you get a max of 2 warnings, and then THE fine!

Anywhere on the streets or open spaces is fineable (if it`s not on your own property, or a rented space).

Ask your Gemeinde to clarify for your area.

Re: Private parking - warning or what?

I sent them an email about three weeks ago, no answer. I guess I have to go there myself and tell them to read it
