Parking ticket head-shaker

Ok. So I got a parking ticket for leaving my bike in a spot not specifically designated as a motorcycle parking area. Ok. My bad. 40 Franks, grumble grumble (about 15 bikes park here daily) grumble grumble (I even asked two separate police officers if I could park here. "No problem," they said) grumble grumble.

I was also hit for 100 Franks for driving into a posted no-entry street for motor vehicles. But here's the thing: all the designated motorcycle parking spots were farther up in this street. So, um. I guess I was supposed to park in a white-outlined velo/moto spot at least 50 meters into the street without driving there?

BTW, this low-traffic street is close to the university and has yellow parking spots for cars as well as marked motorcycle parking.

The 40 Franks I could swallow, but I don't really think this extra 100 Franks is fair. I don't want to pay it.

I had the idea to write a letter explaining the confusing signage. Some have suggested instead that I write a letter claiming that I did not drive into the street, but pushed it as I was parked only about 4 meters into the street.

What do you think?

I am making my license here and my teacher said that motorcycle parking is a mess: In every other country I know, you are by default allowed to park a car unless there is a sign that prohibits it. In Switzerland it is the other way around: it is illegal to park anywhere which is not a designated parking space. So far so good for cars. But: It is of course illegal to park a motorcycle on a car parking space.

So in principle it is illegal to park it anywhere unless the handfull of designated, as in "painted", motorcycle parking spaces. Rule of thumb is: Make sure it is not on the street, but on a broad line of sidewalk, easily leaving plenty of space for strollers/wheelchairs and being far away from any potential fire access.

Still: If the traffic police has a PMS day, you have a fine. Accept it as some sort of tax... otherwise you just get annoyed on a monthly basis.

Can they actually prove you drove there, and not just wheeled your motorbike to the parking place?

If not I'd contest it. It's worth a go for 100CHF..

He can contest but he should know that this case could end up in front of a judge and if he looses, all kinds of admin fees will be included.
IMHO, go ahead and pay and put it in the past.

agreed, I can speak from experience that you are guilty unless proven innocent in these regards and if you argue you are more guilty....

long story but the result was 3000 francs for passing an off duty policewoman on the wrong side
ouch
.... so for the sake of 'eis lapa' I'd pay the lad....

Thanks, I didn't know those "fees" for examining your case were quite that high. BEJEEBUS, that's a lot of money.

Practical demon is on my right shoulder saying, "pay the damn fine." Righteous demon is on my left saying, "WTF?? How can it be possible?"

Indeed, how can it be possible that the legal parking parking place is in the middle of a street where vehicles are not allowed to enter?

was this in basel? surely there must a clearly defined regulation on how parking places must be laid out and where....? They just cant slap a parking area anywhere. There must also be a regualtion on signage....

But finding the info might be a bit hard here maybe? In UK I think of it as bit of a sport, my mates get tickets and I get the councils to cancel them because of poor signage/ non compliant road markings etc, doubt its the same here tho.

If you've got a CAP insurance policy I think it would cover legal fees etc. Not 100% sure but worth a try if you don't want to give them the benefit of the doubt!
