Regarding unpaid internet bill

Hi,

I don't know if this is the right sections. But anyway..
I left Basel last year in April and when I left I asked the orange communications(where I bought a plugin internet USB) to cancel the contract. They said they would, and I did not ask for a written confirmation because I just trusted them. But apprantly they didn't cancel it I guess. I have moved to Munich and Today I received a letter from a company, Intrum Justitia, a bill for CHF 868 for unpaid Orange bills. This company, orange said, is the bill collecting company for orange and many other providers. I am surprised that they found me in Munich and sends me this huge bill, and I am surprised they didnt cancel the contract. I am a bit shocked about this huge amount because student and I dont have so much money..
I called orange and they asked me the name of the person in the store, which I don't know because every time there is a different one. If I am clever enough to note the name of the person, I would have well asked for a written confirmation rather than trusting him.
I also called Intrum Justitia and they said they cant help.
Any suggestions? please

Sorry, but I think you should absolutely always do the cancellation in writing and registered post. Otherwise you simply have no control over it, nor can you prove it afterwards.

Try to find your copy of the exit declaration with your local authorities in Switzerland and send that with your explanation to Orange, maybe they will be open for a compromise... (if you leave the country and do a proper cancellation with this letter from the Gemeinde, normal contract cancellation periods do not apply - at least for phone contracts).

...are you by any chance related to a guy named Phil?

Obviously, you have no proof that you told them to cancel the contract and therefore, they have no reason to believe you.

Yes the normal cancellation perioddo not apply when I do it when I leave. But now its almost a year has passed. Is there anything I could do?

...now, those calls made to the orange customer service line I believe are recorded...and therefore you might have a small chance of beating the bill.

Thanks for the suggestions. Unfortunately it didnt work. They ask for the exact time, date and number of the call. Since its a long time ago, I dont remember. I gave the number, but they couldn't trace.
I wonder what they will do if I don't pay.
This bill would be a big deal to me since I am still a student.

I had a dispute with Orange after I cancelled my Orange 20 account after 2 years and went prepaid. A month later Orange billed me under Orange 20. I called them up and they had a full record of the times and dates of calls in relation to my Orange phone number.

This is the key to finding out your situation. You either still have an Orange number or you don't. Either way it will resolve the problem: if you still have a number they can find out when you called and if you don't you can ask what are they billing you for...

I did not have an Orange phone connection but only an internet. When I called them last time which was around may or june 2010 to ask if the contract was properly cancelled, they told me they couldn't find my name, so I did not know what else to do.
I didn't call from an Orange number because I never had one.
But they are billing for the internet. I had left Swiss around a year ago. I hadn't used the connection all this time of course (It was only a wireless USB internet). Even if I had used, it shouldn't have cost so much. I don't understand why the collection agency sends the bill after all these months. If they found they bills are not paid, they could have contacted me earlier.

The collection agency will have added their own "collection" charges. Hence probably 1/2 of that really is Orange

Yes thats true. Almost half of it is termed as fine or some charges. Will it be wise to try to bargain with them?

Well, I hope you will get it sorted out...

Make sure you find someone reasonable who will pick up the phone in Justitia and they will ask you to write your side of the story. Then try to get evidence from Orange in form of history of your account.

I dealt with Justitia lately over unpaid UPS bill which they mistakenly billed me twice and even despite my intervention with the UPS themselves, agent still insisted I must pay it. After exchange of few emails, there was silence and I thought the whole matter was settled. Not until debt collecting agency sent me the letter.

I stayed calm, picked up a phone and called Justitia and explained to them the whole thing about mistake being made in English. The lady on the other side was very helpful and asked me to write my "opinion" i.e. side of the story.

All I can say try to track it down to detail, explain what happened and only can hope that eventually you will get it right.
