Charged 500 CHF for cancelling a 24 month Orange contract 1 month early

Does anyone know if I can get out of this? It seems unreasonable even though now I see it is in the contract. I looked at the Ombudsman website and there seems to be comments saying that charges should be prorated on the remaining time left on the contract although my French is poor. I was wondering if anyone else had had a similar issue before I call the Ombudsman or contact a lawyer through my Protection Juridique.

I actually switched to Swisscom as I was getting very poor reception with Orange just about everywhere. Reception has been much better everywhere with Swisscom.

The mistake I made was to only read the new Swisscom contract which only says you need to complete the monthly charges til the end of your contract and not pay a huge fee like with Orange. It would have only been 30 CHF had this been the case.

I honestly dont know the answer but .. . could you call them back and say youll keep the contract?

If they want to charge you 500chf because you want to cancel the contract 1 month early........just wait 1 month and then cancel the contract.

I am i missing something here??

Sounds insane....
They should only charge you the monthly fee of the remaining month.

Hindsight is a nagging thing.

I too think this is obscene, I would highly suggest you speak to Swisscom and let them know they did not warn you. Be calm and polite, keep talking hopefully they can come up with a solution.

Are you sure you dont have an automatic yearly renewal contract with three months notice in advance be for contact expiry? Then to cancel one month before end of contract defacto means you cancel it for 13 month later.

Orange doesn't do this usually.
If you say nothing, then they let you keep the contract and you can cancel any moment with 2 months notice.
Swisscom does the same.

It's Sunrise that forces this automatic renewal for a year.

That's why I get only prepaid cards... It sounds insane: 500 bucks for one month.

Actually Orange do enforce it. It happened to me when I wanted to switch and was caught out. As it didn't really make any great difference to me and they dangled enough goodies in my way that it was worth staying, I wasn't that concerned.

But they do insist upon the 3 month notice.

Sunrise are a right PITA regarding this. I sent my cancellation letter over three months before the cancellation date ( and they only require 2) but when I checked my account later they'd still renewed my contract for another year.

Fortunately for me as well as having the receipt from the recorded delivery and a copy of the letter I sent I also had a reply from them in response my letter so it was impossible for them to say they hadn't received it.

Swisscom also reinforces the three month rule. But even if Orange does, why 500CHF unless you have one of those expensive contracts.

Yes they do, as well as Sunrise.

And Orange, since it's been bought by I don't remember which company, is having huge reception problems. Basically, Sunrise and Swisscom share the same antennaes and thus have pretty good coverage everywhere. But Orange is trying to cut the costs by not maintaing its oldish antennaes and network is bad and getting worse.

That's interesting because my OH has Swisscom ( company phone) and I have sunrise (because we have to pay for it ourselves) and he gets much much better reception than I do absolutely everywhere. The sunrise reception is absolutely abysmal anywhere around these parts.

Sorry, I have to insist.
To my knowledge Orange (like Swisscom) does not extend the contract for another 12 months. Yes, they want you to give them 2 (or is it 3?) months notice. So if you forget to tell them by the 10th month, then you have to stay until the 13th or the 14th. But no, they won't make you stay for another 12 months.

I think your story actually confirms this. If they could legally bind you for another 12 months (according to what you had signed) they would not offer you all the goodies to convince you to stay.


With Sunrise it goes like this:
C: Hi, I'd like to cancel my contract.
S: Sorry dude, it's 45 days until the end of your contract, we extended it for another year. Call us in 10 months to have it cancelled.
C: Will you at least offer me a phone?
S: No, you could have asked for an offer for a phone before the 10 months, but since you didn't, your problem.
C: This is insane.
S: Have a nice day.

Id like to thank the OP for the heads up on this! We signed a contract today for Orange and because of this post we only signed for 12 months rather than 24.
