Legality of VPN

Is it legal to use a VPN to access a site which only allows streaming in the US? I know that people use them all the time, but I would like to be able to use one of these sites for work and, therefore, it must be legal if I do. I'm not sure where to look to check the legality of this.

You'll need to check the T&C of the website you want to access, but most (if they block by IP address) will not allow you to.

Hi, thanks for replying! I don't quite understand your response though. I know that the website do not allow it, but that does not necessarily make it illegal. Would I be breaking Swiss law by using one?

You would be breaking their terms and conditions - and while I'm not a lawyer, I believe here like in many countries there's a divide between contract law and criminal law.

So, in my layman's view (and I'm sure someone will come around to correct me ), I believe you would be in violation of the contract you agree to when you sign up to the service.

Worst case scenario I think would be they threaten to sue, but I doubt that's going to happen. Maybe something about copyright and violation of copyright? Not sure, someone better equipped will be around soon... I'm just 1st line support (have you tried turning it off an on again? :P)

The division is civil law and criminal law. Since you'd be breaking the contract, that wold be civil law. And that means they could sue your employer in Switzerland under Swiss law.

However, if you were to download the content from a torrent stream (for example), that wouldn't be breaking any civil or criminal law.

What does T&C say about further copying/moving the already downloaded content? Does it say anything at all?
Technically, you can download it to a virtual desktop hosted at US provider, and then copy or move from virtual desktop to your local desktop hosted in CH.
In fact, there are even 3 ways to get this content in CH:
- VPN - most questionable
- US Proxy - less questionable
- Virtial desktop - least questionable, if copying/moving is not prohibited
